Revocation of Agreement:

EasyFax reserves the right to end this agreement if the terms outlined are not followed. In the event of termination, all materials must be destroyed immediately.

Fax Retention Policy:

Your fax messages received through your EasyFax number will be kept in your EasyFax Message Center for a limited time frame, which is up to 12 months while your account is active.

Note that the Company has the right to alter its practices and limitations for this feature at any time, including but not limited to changing the maximum storage duration, maximum number of messages stored, and the maximum storage space provided on the Company’s servers.

The Company is not responsible for any issues with the storage feature, including data loss or deletion.

Once your account is closed, all your faxes, including those stored in the EasyFax Message Center, will be permanently deleted, and the Company will not be held liable for the deletion.

Email Services:

You understand that the Company is not responsible for any issues with the email feature, and that they have the right to modify the feature's terms of use at any time, including, but not limited to, email size limits, storage space, and spam/virus protection.

By using the email feature, you acknowledge that you alone are accountable for the contents of the emails you send, and that you may face liability for their transmission.

The Company will not be held responsible for any errors or malfunction of the email feature, including, but not limited to, incorrect email transmission, email deletion or loss, broken links, or viruses received through the email feature.

If the Company finds or suspects that any emails sent or received through the feature are illegal or violate this agreement, they reserve the right to delete the emails and/or deactivate email links without prior notice.

Large File Transmission Feature:

A feature is provided to you which allows you to grant internet-based access to large files that cannot be sent through email (known as "Large File Transmission").

This feature can be used through the EasyFax My Account website after logging in. You can upload the files, add recipient email addresses, and upon submission, recipients will receive an email with a link to access the files.

You acknowledge that Large File Transmission is provided to you only as a convenience. Additionally, you understand that the links to the uploaded files are public and unsecure and can be forwarded freely by your recipients or by other third parties who you did not select.

The Company is not responsible for the security, confidentiality, or privacy of files uploaded through this feature.

By using this feature, you accept sole responsibility for the content of any files uploaded, hosted, or transmitted and agree to assume any liability that may arise from the transmission of your files, even if the recipient was not designated in your original Large File Transmission submission.

The Company is not responsible for any failure or malfunction of this feature, whether it prevents you from using the feature or not.

This includes but is not limited to: errors in the Large File Transmission submission process, loss of uploaded files, non-receipt of notification emails, broken links to uploaded files, or rejection of files for any reason, including the presence of a virus.

The Company reserves the right to alter the terms of this feature at any time, including changes in the maximum number of days that uploaded files are retained, the maximum cumulative upload size per submission, the maximum number of files stored at a time, and/or the maximum storage space on the Company's servers for your uploaded files.

If the Company determines or suspects that any uploaded files violate any laws, regulations, or the agreement, or if you are in breach of any provision of the agreement, the Company has the right to remove your stored files and/or deactivate links to the files without further notice to you.

Client Obligations:

You bear full accountability for the material in your communications via the Services. The Company operates only as a neutral platform for you to transmit and receive information at your discretion.

However, the Company holds the right to execute any action relating to the Services if deemed necessary or appropriate in its sole judgment, in the event that the Company perceives you or your information as posing a risk to the Company or compromising the Services for you or other customers, or resulting in the Company's loss of service from ISPs or suppliers.

Your utilization of the Services is subject to all relevant local, state, national and international laws and regulations, including, without limitation, those governing payment collection, export control, consumer protection, anti-discrimination, unfair competition, securities, and false advertising. You agree to:

• Abide by all laws regarding the transmission of technical data exported from any country through the Services.
• Refrain from using the Services for illegal activities.
• Not disrupt or interfere with networks linked to the Services.
• Comply with all policies and procedures of networks connected to the Services.
• Avoid using the Services to infringe on any third party's proprietary rights, such as copyrights, patents, trademarks, trade secrets, rights of privacy or publicity.
• Not use the Services or related software to deliberately transmit false or misleading caller ID information for any purpose, including fraud, harm, or wrongful gain.
• Not transmit or upload, through the Services, any unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene or otherwise unacceptable material of any type.
• Not promote conduct that could result in criminal offense, civil liability or violate any local, state, national, or international law or regulation.
• The Services make use of the Internet to transmit information, so your behavior is also subject to Internet policies and procedures. You agree not to use the Services for chain letters, junk fax or mail, spamming or distribution lists to individuals who have not given permission to be included. Also, do not try to gain unauthorized access to other computer systems. You are prohibited from interfering with another client's use and enjoyment of the Services. You also agree not to store "protected health information" unless using the Company's Enhanced Security feature, or information that imposes obligations on the Company.

You are responsible for:

1. Obtaining and paying for all necessary equipment and third-party services, such as internet access and email, to access and use the Services.
2. Ensuring the security of your PIN/password and other confidential information related to your Services account.
3. Promptly informing the Company of any unauthorized use of your account or other security breaches.
4. Being liable for all charges resulting from the use of the Services, including unauthorized use before informing the Company and preventing future incidents.

Customer Declarations:

By entering into this Agreement, you declare and guarantee that you are either 18 years old or have reached the age of majority in your residing country, state, or province.

Additionally, you confirm that you have the legal capacity and authority to enter into this agreement.

You acknowledge that you are fully responsible for all financial aspects related to your usage of the Services, including the usage of your account by others (such as minors living with you), and agree to fulfill all obligations stated in this Agreement.

Disclaimer of warranties & limitation of liabilities:

The Company's software and services are offered "as is" without any express or implied representations or warranties. No warranties of usability, condition, operation, merchantability, title, fitness for a purpose, non-infringement, compatibility, security or accuracy are provided.

Using the Company's software and services is at your own risk. You assume full responsibility and risk of loss from downloading, uploading, or using files or materials (including software), or loss resulting from unauthorized access or alteration of your transmissions, data or files.

Neither the Company nor its affiliates, licensors or service providers will be liable for damages (direct or indirect, including special or consequential) arising from your use or inability to use the software and services. The maximum liability of the Company and its affiliates, licensors and service providers, and your exclusive remedy for any breach of this agreement is limited to the lesser of (1) the amount paid by you for the software or services in the past 3 months, or (2) $500.

The Company and its affiliates, licensors and service providers are not responsible for any communications difficulties that may lead to interruption of data delivery service. You will not rely on any representation or warranty made by anyone other than an authorized officer of the Company in evaluating the services.

Possession:

All components of the Services, including but not limited to programs, services, processes, designs, software, technologies, trademarks, trade names, inventions, and materials, are the exclusive property of the Company, its affiliates, licensors, and service providers, unless otherwise specified.

You are not allowed to utilize the trademarks, trade names, patents, copyrights, or any other intellectual property of the Company or its affiliates without obtaining prior written consent from the Company.

Protection:

You are responsible for safeguarding the Company and its affiliates, licensors, and service providers from any legal responsibility, costs (including lawyer fees), and harm stemming from claims related to the use of the Services.

This includes, but is not limited to: (a) violating the terms of this agreement through your own actions or those of someone using your account, (b) accusations of defamation, violation of privacy rights, or publicity, (c) disruption of service to other customers, (d) infringing on the intellectual property rights of third parties, and (e) breaking any laws or regulations - such as those prohibiting the transmission of unwanted fax advertisements.

Prohibition of Service Resale:

The resale, rental, or leasing of the Services is strictly prohibited.
